An all-terrain vehicle (ATV) is any self-propelled vehicle with two or more wheels that is manufactured for sale to be used primarily off-highway or in off-road competitions, and that is no wider than 70 inches and weighs no more than 1,000 pounds. This does not include vehicles manufactured for off-highway use and designed exclusively for travel on snow or ice, and supported by one or more skis, belts or cleats that utilize an endless belt tread. Those vehicles, which include snowmobiles, are subject to other laws and regulations.
An ATV must be registered with the Department of Motor Vehicles (DMV) if it is operated anywhere in New York State, including on the owner's property.
When you register a new or used ATV for the first time, your registration will expire each year on August 31. Registrations for ATVs originally registered before April 1, 2005, will continue to expire each year on April 30.
ATV dealers are required by law to register every ATV they sell to New York State residents or to non-residents before the purchaser takes delivery; unless the purchaser qualifies for an exemption from registration. A purchaser is exempt from registration when the ATV will be used exclusively: outside of New York State; at special events; for agricultural purposes; or for snow plowing other than for-hire. Dealers must have the purchaser complete and sign a "Declaration of Exemption From Snowmobile or All-Terrain Vehicle Registration" (RV-6).
Unless you qualify for an exemption from registration, you cannot take delivery from an authorized dealer until after the ATV is registered.
If you buy an ATV from a person who is not a New York State registered ATV dealer, you must register the ATV with the DMV. To register the ATV; you must complete an "Vehicle Registration/Title Application" (MV-82) and submit it to a motor vehicle issuing office. To register an ATV; you must provide proofs of ownership, sales tax payment or exemption, your identity, and your date of birth.

If you buy your ATV from a registered New York State dealer, you should receive a bill of sale in addition to the acceptable documents that prove ownership. The bill of sale must contain the dealer's name, address and dealer registration number, plus your name and address, the ATV vehicle identification number, the year, make, model, and number of wheels. The bill of sale also must indicate that the ATV is either new or used, and must confirm that the dealer has collected the appropriate sales tax.
If you buy the ATV from a person who is not a registered dealer, you must pay the sales tax at a motor vehicle office. To determine the proper amount of sales tax, the DMV needs proof of what you paid for the ATV. Have the seller sign and give you a Statement of Transaction- Sale or Gift of Motor Vehicle, Trailer, All-Terrain Vehicle (ATV), Vessel (Boat), or Snowmobile (pdf) (at NY State Department of Tax and Finance) (DTF-802). You must submit this form to the motor vehicle office, and pay the appropriate sales tax, before registering your ATV:

To register an ATV, you must provide proof of who you are. You must provide proof of identity, date of birth, and at least six points of proof of name. For the most recent listing of acceptable documents see "Proofs of Identity For Registration and Title" (ID-82).

The ATV registration and registration renewal fee is $12.50 per year – it is not prorated by month. You also must pay a $12.50 license plate fee when you first register your ATV. You will be issued a plate, a registration sticker and an attached registration document. The plate must be attached to the rear of the ATV, and the sticker should be placed at the right side of the plate. You should carry the registration document when operating your ATV.
You may not operate any ATV anywhere in New York State, except on your own property, unless it is covered by liability insurance. Minimum required coverage is $50,000/$100,000 for death, $25,000/$50,000 for injury, and $10,000 for property damage in any one accident. You must show proof of this insurance upon the request of a judge, the police, or a person claiming to have suffered injury or property damage from your operation of the ATV.
If you move, cross out the old address on your registration document and write in the new one. You also must report your address change to the DMV within 10 days.
If your ATV has become stolen, you should immediately report the theft to the police. If the ATV is to be, or already has been, destroyed or permanently removed from New York State, you should surrender the plate and registration document to a local motor vehicle office.
New York State honors valid out-of-state ATV registrations. If your home state does not require ATV registration, you must obtain a New York State registration before operating your ATV in this state.
You do not need a driver license to operate an ATV in New York State, but certain restrictions apply to operators under age 16.

RESPONSIBILITY OF PARENTS AND OWNERS
A parent or guardian may not knowingly permit or authorize a child under age 16 to operate an ATV in violation of state or local laws. An ATV owner, or another person in possession of an ATV, may not knowingly permit or authorize any person under age 16 to operate an ATV in violation of any state or local law.
Both the owner and the operator of an ATV may be held liable for injury and/or damages resulting from an ATV accident.
DMV recommends you avoid crossing a highway unless absolutely necessary. If you cross, you must follow these rules:
You may not operate an ATV on a highway unless it has been designated and posted for ATV use by the state or local authority. Usually, only the part of a highway between two off-highway trails will be posted for ATV use. Check with local police to be sure. DMV recommends that you turn your headlight and taillight on and wear bright, reflective clothing whenever you ride on a highway. Always enter the highway with care, and yield to other traffic.
You may not operate an ATV on public land unless it is specifically designated for ATV use, and it is allowed by a posted sign.
To operate an ATV on private land, you must have permission of the land owner or lessee. If you receive permission, make sure you know the boundaries of the property, and respect any special restrictions or requests of the land owner. You could lose permission to ride on private land by littering, causing damage, or riding carelessly.
Whether you are the operator or passenger, you must wear a USDOT-approved helmet when riding an ATV. DMV recommends that you also wear a face shield or goggles, and protective clothes and footwear.
Your ATV must have the following equipment:
The law requires you to keep the ATV's headlight and taillight lighted when riding a half hour after sunset to a half hour before sunrise. For greater safety, DMV recommends you keep the lights on at all times.
In addition to obeying the ATV laws and rules, it is wise to ride your ATV with common sense and courtesy. Having fun on an ATV does not include annoying others or taking foolish risks. ATV riders who ignore the rules and the rights of others may cause ATV operation to be restricted or prohibited on private and public lands.
No locality may require its own ATV licenses or registrations, but it may impose additional restrictions or rules on ATV operation. Find out about special ATV rules in your area, and obey them.
The person in charge of an ATV special event or off-road competition must apply to the local jurisdiction for written authorization at least 30 days in advance, unless it is held entirely on private property.
If you are involved in an accident with your ATV, you must give your name and address, the name and address of the ATV owner and the plate number to injured persons, the owners of damaged property, and/or the police. You also must show proof of insurance to persons claiming to have suffered injury or damage. If property is damaged, and you cannot locate the owner, you must give the above information to police as soon as possible.
You must immediately report to the police any accident that involves death, personal injury or damage estimated at $600 or more to the property of any one person.
You must also file a Report of Motor Vehicle Accident (MV-104) with the Department of Motor Vehicles about an accident that results in a fatality, personal injury, or property damage estimated at $1,000 or more. You must file the report within 10 days of the accident and send a copy to the county sheriff or police commissioner.
If you are incapacitated, the written report may be filed by another party familiar with the accident. The investigating police officer must also file a written report, but that does not relieve you of your legal responsibility to file one.
Failure to report an accident is a misdemeanor. A conviction may result in suspension or revocation of your safety training certificate and/or the ATV registration.
The Department of Motor Vehicles may suspend your safety training certificate and/or the ATV registration until you file an acceptable written report.

Off-Highway Vehicle Registrations & Permits
NEW Process: Colorado Parks and Wildlife will no longer provide a bright green temporary registration by mail for new registrations or renewals. Instead, customers can now use their emailed confirmation receipt (valid for 60 days) as their temporary registration until you receive your registration card and decals in the mail. The emailed confirmation receipt will be sent to the email address you have on file. If you do not receive your registration card and decals within 30 days, please contact Colorado Parks and Wildlife at 303-297-1192.
All OHVs must have either a current/valid Colorado Registration Card and two Decals or one Colorado OHV Permit to operate in Colorado. This includes while in route, in staging areas and on public land roads and OHV designated trails.
Regardless of when they are purchased, both OHV Registrations and Permits are valid from April 1 through March 31 each year and are required annually. Both registrations and permits are nonrefundable and nontransferable.
Existing registrations can renew 45 days in advance of the March 31 expiration date. You’ll need your customer identification number (CID) and vehicle registration number to complete your renewal.
Resident OHVs must have both a valid OHV Registration card available with the vehicle, and two current OHV Registration decals properly displayed on and affixed to the vehicle. Fees include the search and rescue fee.

Renew an Existing OHV Registration

Existing registrations can be renewed 45 days in advance of expiring. Vehicle owners can renew online, by phone (800) 244-5613, or in person at most CPW Locations. Call ahead when visiting a location to make sure they offer the service(s) you need. You’ll need your customer identification number (CID) and your vehicle registration number. Your registration card and official decals will arrive by mail in approximately 10-20 business days.
If you want to ride within the next 30 days, you’ll want to print your registration confirmation receipt. Your registration confirmation receipt will be emailed to your email address on file shortly after your purchase. You are required to carry your registration confirmation receipt on you while in the field, until you receive your registration card and decals.
If you do not receive your registration card and decals within 30 business days after a new registration submission or registration renewal, you should contact the CPW call center Mon. - Fri. between 8:00 a.m. and 5:00 p.m. MT (303) 297-1192 or visit a CPW location for help researching your issue.

If your registration card or decals have been lost, stolen or destroyed, you will have to purchase a duplicate registration. Duplicate registrations can be purchased online, over the phone at (800) 244-5613 or in person at a CPW location. If purchased in person at a CPW location, you will not receive your registration card and decals immediately. CPW staff will provide you with a new temporary registration and your registration card and decals will be mailed to your address on file.

Purchase online or by phone (800) 244-5613 and the bright green non-stick permit will arrive by mail in approximately 10-20 business days. Make sure you print or download your confirmation receipt. Your permit confirmation receipt will be sent to your email address on file shortly after your purchase. It includes the Temporary Authorization Number (TAN), valid for 45 days, and is the authorization to ride while you wait for your OHV permit to arrive in the mail. Carry it with you.
Purchase in person at CPW Locations or sales agents and the permit will be given to you. Call ahead for hours of operation, especially if planning to ride on a weekend or holiday.
Colorado OHV Permit (sticker)

Dealers are required by law to complete the registration application for you and collect the registration fee before the vehicle leaves their premises. The dealer will forward the application to our office where we will process the request.

According to the Tax Code of the Russian Federation, the ATV is not included in the list of vehicles that may not be taxed. In other words, Article 358 determines the need to pay the fee. At the same time, taxation issues are disclosed in detail already in Article 52 of the Tax Code of the Russian Federation. For example, each taxpayer must be sent a settlement letter at least one month before the due date.

The settlement document must arrive to the taxpayer no later than July. But in practice, it can reach the addressee in October and even later. Therefore, it is better to carry out a simple calculation yourself in advance so that the final figure does not come as a surprise at the end of the year.
To perform the calculation, it is necessary to determine the engine power, calculate from what month the ATV has been owned by the current owner, and also clarify the tax rate of a particular region of registration. In the event that the engine power exceeds 50 hp, the rate is doubled. Even if the vehicle is not used, but was purchased, the owner is obliged to pay tax on it. If the amount of tax received is fundamentally different from that indicated on the receipt, you must re-check your own calculations. If everything is correct, the owner should contact the tax office and find out why the amount is too high or too low. Each ATV owner will have their own tax amount. In addition to power, the indicator depends on the region, since each has a certain tariff rate. Of course, the base value is determined by the Tax Code of the Russian Federation. The authorities of the region can lower or raise the indicator up to 2 units.
To find the coefficient, you need to use special tables (ATV refers to other self-propelled vehicles). On average, for residents of small towns, it will be 1.5-2 times less than for riders who live in large cities and metropolitan areas.
The tax is calculated for each full month of using the vehicle during the year. If the owner sold the ATV in June, he only pays the tax for 5 months, and the new owner will pay the rest. Each region has its own details for making a payment, which can be obtained from the tax office or on the website.
Payment can be made directly in the building of the tax service through the cash desk or terminal, or use the functionality of the website of the State Service. It is important to correctly enter all the necessary data and carefully check whether the information about the ATV matches those indicated in the vehicle passport.
If the payment of the tax fee does not arrive on time or the taxpayer ignores the amount indicated in the settlement document, a fine will be imposed in an amount exceeding the fee itself. If after that neither the tax nor the penalty is paid, the recovery of the amount will be carried out in court. At the same time, the owner of the transport must pay not only the fine and the debt, but also the state duty with shipping costs. To obtain the required amount, there may be two court decisions.
ATV is seized, sold, and the funds received are used to pay off debt obligations. If the transport is subject to arrest, payment of paid parking is carried out by the taxpayer. You can pick it up only after the full payment of all debts and receipt of the relevant document.
This could be wages, stipends, pensions, profits or other items of income. In this case, the tax service sends an appropriate letter to the employer or other authorized organization indicating the amount of the debt.
If an ATV is owned by a legal entity and is part of the company's fleet, the tax office performs an individual vehicle tax calculation based on the data received. The final amount is sent by settlement letter within six months after the last payment was made.
The changes also affected the need for self-calculation. Of course, every taxpayer has the right to control the amount. But now, in order to obtain the tax value, you can submit an application to the tax service, and after 5 working days you will receive a ready calculation. In this case, it is no longer necessary to be tied to the place of registration of the vehicle. If the ATV is under arrest, impounded or not used due to an accident, no tax is charged for this period.
The size of the tax rate, depending on the region and the power of the ATV, is not yet subject to change in accordance with the Tax Code of the Russian Federation. The formula also remains the same, so it can be used for calculations. You can get accurate information directly from the Federal Tax Service or on their official website. You can also always use the functionality of the State Services website, where tax payment is quick and easy.
ATV tax of any capacity is mandatory for any person or entity that is the owner. The road tax for all-terrain vehicles will not be abolished, as this type of vehicle is in demand, especially in the northern regions. At the federal level, changes are possible that will relate to the size of the rate. But so far, no new bills or amendments have been put forward.
It is also worth considering that tax laws change quite often, so it is necessary to get acquainted with new information on this issue in order to correctly pay the tax.
