ATV, UTV, and Minibike Salvage Titles

When an insurance company acquires a salvage ATV, UTV, or Minibike through payment of a total loss settlement due to damage, a Salvage branded Certificate of Title must be issued in the name of the insurance company.

In the event a total loss settlement is paid and the ATV, UTV, or Minibike does not meet the definition of salvage, an original Certificate of Title must be issued in the name of the insurance company.

If, after the insurance company has paid a total loss settlement, the owner (insured) of the damaged ATV, UTV, or Minibike chooses to retain ownership, the insurance company must notify the Department of Motor Vehicles. The Department of Motor Vehicles will then enter the Salvage brand onto the computer record of the ATV, UTV, or Minibike. The insurance company is also required to notify the insured of their responsibility to obtain a Salvage title within thirty (30) days after the settlement of the loss.

The salvage designation also applies if the owner of an ATV, UTV or Minibike voluntarily obtains a Salvage branded Certificate of Title, regardless of the damage, age or value of the ATV, UTV or Minibike.

A salvage ATV, UTV, or Minibike:

  • is a late model ATV, UTV, or Minibike that has been wrecked, damaged, or destroyed to the extent the estimated total cost of repair to rebuild the ATV, UTV, or Minibike and restore it to its condition immediately before it was damaged, meets or exceeds 75% of the retail value of the ATV, UTV, or Minibike at the time it was damaged or voluntarily designated as Salvage by the owner.

Late model ATV, UTV, or Minibike is an ATV, UTV, or Minibike that:

  • is 7 years old or less, as determined by the manufacturer's model year designation, or
  • has a retail value of more than $2,250 until January 2020 when it increases to $2,500.

 

Cost Of Repairs

The estimated or actual retail cost of parts needed to repair an ATV, UTV, or Minibike, plus the cost of labor computed by using a customary and reasonable hourly labor rates and times. Retail cost of parts and labor rates may be based upon collision estimating manuals or electronic computer estimating systems customarily used in the insurance industry.

 

Retail Value

The actual cash value, fair market value, or retail value of an ATV, UTV, or Minibike as:

  • set forth in a current edition of any nationally recognized compilation, including automated data bases, or
  • determined according to a market survey of comparable ATV, UTV, or Minibikes with respect to condition and equipment

If an Out-of-State title is presented with a brand indicating damage, or any records readily accessible to the Department of Motor Vehicles indicates damage, the brand will be carried forward along with the name of the jurisdiction who issued the previous title, on the Nebraska Certificate of Title. This includes, but is not limited to , the following notations:

  • Damaged
  • Flood
  • Junked (in those states where this is not a death certificate)
  • Manufacturer Buyback
  • Non-Highway Use (not eligible for registration)
  • Previously Salvaged
  • Rebuilt
  • Reconstructed
  • Repaired
  • Total Loss
  • Any other language indicating damage

Once an ATV, UTV, or Minibike with a Salvage brand Certificate of Title has been repaired, a Vehicle Inspection must be performed and a Vehicle Inspection Certificate must accompany the application for title, before a new title can be issued. The new title is required to have the words “Previously Salvaged” branded on the face under the designation, Legends. All brands must be carried forward on any titles issued thereafter.

A Salvage brand Certificate of Title is obtained by submitting the Certificate of Title and a properly completed Application for Certificate of Title to any County Treasurer (refer to the County Treasurer Listing for contact information).

The fee for a Salvage branded Certificate of Title is $10.00. Please contact the County Treasurer where the application for title is submitted for information regarding acceptable methods of payment.

    You may now include an email address for notification of your salvage exam.  This will allow for appointments to be scheduled sooner.

    DMV no longer accepts the MV-899/MV-82TON applications.

 

What is a salvage vehicle?

By law, a 'salvage vehicle' is a vehicle that

  • was transferred to or acquired by an insurance company with a Salvage Certificate (MV-907A) because it has significant damage (because of a collision, theft, vandalism, or from water)
  • has repair costs that are more than 75% of the pre-damage retail value of the vehicle
  • was issued a salvage title from another state and brought to New York
  • was declared a 'wreck' on the back of its New York State title by the owner at the time of sale or transfer

If a salvage vehicle is rebuilt for use on roadways, the DMV must examine it before issuing a new title certificate or registration. The required examination is part of the NY State Auto Theft Prevention Program. The program includes

  • vehicles that were issued a NY State Salvage Certificate (MV-907A)
  • rebuilt salvage vehicles from most other states

A NY State Title Certificate issued after the date of May 18, 1999 for a rebuilt salvage vehicle displays the brand, 'REBUILT SALVAGE'. Some title certificates issued before May 19, 1999 also show this brand.


The salvage vehicle examination is not
  • a safety inspection
  • an emissions inspection
  • an insurance examination

 

Why is this examination required?

New York State law requires the DMV to determine if a rebuilt salvage vehicle is stolen or includes stolen parts. The purpose is to

  • protect consumers
  • find stolen items
  • prevent the theft of vehicles and vehicle parts

 

What type of vehicle needs a Salvage Examination?

A salvage vehicle that is recovered after a theft or rebuilt after the damage must be examined by the DMV before the DMV can issue a new title.

If the proof of ownership for a salvage vehicle is a NY State Salvage Certificate (MV-907A), the DMV will not issue a title certificate without a salvage vehicle examination.

The DMV will not examine or issue a title certificate for a rebuilt vehicle that has an out-of-state title certificate or a Salvage Certificate (MV-907A) that is labeled

  • 'parts only'
  • 'non-rebuildable'
  • 'non-repairable'
  • 'scrapped'
  • 'destroyed'

These types of vehicles are deemed not roadworthy.

The DMV will not examine or issue a new title certificate or vehicle registration for a rebuilt salvage vehicle that does not have a title certificate or Salvage Certificate (MV-907A) that proves ownership.

Note: If the DMV finds that a recently registered vehicle has a salvage history, the DMV will notify the customer that the vehicle must go through the salvage vehicle process. The DMV will not issue a New York State title or allow you to renew your vehicle registration until the vehicle is examined and the title is issued.

Once the vehicle completes the salvage examination process and a title is issued, the owner can register the vehicle.

Registering an ATV is a mandatory procedure, which is no less important than obtaining a driver's license. This requirement is provided for in the administrative code and is mandatory. Some owners of such motorcycles doubt whether it is necessary to register an ATV and register it. It is worth considering that it is not always possible to move exclusively on rough terrain. If the traffic police officer stops the ATV driver, he will demand the right, documents on registration and technical inspection. If they are not found, you will need to pay a large fine. The ATV is confiscated until all circumstances are clarified, which is also fraught with additional costs. Therefore, drivers who have paid a significant fine agree that registration of an ATV with Gostekhnadzor or the traffic police is necessary.

Where is ATV registered?

Gostekhnadzor is engaged in registration and control of the operation of self-propelled equipment, which is an ATV. The procedure is mandatory for ATVs with an engine capacity of more than 50 cm³. Also here you can deregister the ATV in case of its sale or impossibility of operation.

It is worth considering that the presented motor vehicles are relatively new for our country. Therefore, at the moment there is no single bureaucratic definition of what an ATV is. This can be determined by obtaining the relevant documents when buying a vehicle. In most cases, this will be the “Passport of a self-propelled vehicle”. The same documents are issued for tractors, snowmobiles and other similar equipment. In this case, it is required to register the ATV with Gostekhnadzor.

In rare cases, when buying an ATV, the owner receives a “Vehicle Passport” in his hands. In this case, you will need to register the ATV with the traffic police. The vehicle passport is issued by the customs service for mini SUVs and ATVs. However, in the vast majority of cases, with such equipment, a "Passport of a self-propelled machine" is provided.

How to register an ATV?

To register an ATV with Gostekhnadzor or the traffic police, you will need to collect an identical package of documents. This procedure is also carried out according to a single standard in both state organizations. Registration requires payment of a state fee, which is regulated by the Tax Code of the Russian Federation. If you need to register a used ATV, the equipment must pass the state inspection.

It is also worth noting that after the purchase of motorcycles, the owner will have only 5 days to register it with the relevant authorities. If this procedure is performed later, you will need to pay a fine.

If the buyer does not have time to deal with ATV registration on his own, he can contact a special company or use the appropriate service provided by the equipment dealer in the motorcycle showroom. All documents will be processed promptly without the participation of the buyer. This service is not cheap, but it saves a lot of time and effort.

Document package

To register an ATV, you will need to collect the appropriate package of documents:

  • Standard form application.
  • Passport of a self-propelled machine or Passport of a vehicle. The document must indicate who owns the ATV.
  • If the ATV has previously been registered, a relevant certificate of registration will be required.
  • Contract of sale and acceptance certificate with vehicle numbers. It can also be another document that confirms the ownership.
  • OSAGO insurance policy. It is not required for vehicles traveling at a maximum speed of 20 km/h.
  • Motorcycle Compliance Certificate.
  • Transit registration state mark, if it was previously issued.

In addition, in most cases, it is required to present the rights of category "A1" of the tractor driver. Therefore, before buying an ATV, you will need to undergo training at a driving school. Then an exam is taken, after which a driver's license of the corresponding category is issued.

If the entire set of documents is collected, you can go to the local authorities of Gostekhnadzor (or the traffic police). The registration procedure can take several hours, so you need to choose a free day for this. After submitting the application, a receipt for payment of the state fee will be issued. It is paid on the same day at the nearest cash desk. After that, a license plate for an ATV and a registration certificate are issued. Next, you will need to obtain a state-recognized technical inspection coupon.

How to pass inspection?

The law establishes that the inspection of the ATV must be carried out once a year. Alternatively, you can get a conclusion from the Gostekhnadzor on the compliance of the equipment with the requirements for safe operation.

After passing the appropriate procedure, the owner of the vehicle receives a certificate of inspection. This confirms that the ATV is in good condition and will not cause an emergency on the road if it breaks down.

To pass the technical inspection, it is necessary to have a driver's license of the category tractor driver-machinist. Having collected all the necessary documents, you can move on public roads.
